Wm. Hord, the defendant in the action in the lower Court, claims title to a tract of land by virtue of his purchase thereof at a Commissioner’s sale, made on the 20th of November, 1829, in pursuance of a decree rendered on the 9th of October, 1829, upon the joint petition o'l the adult heirs of Indiana Robinson, deceased, and the guardians of her infant heirs, for the sale of a tract of land descended to them.
