OPINION
MUIR, District Judge.
I. Introduction
The Court submitted a special verdict to the jury containing 10 questions. The jurors could agree only to answers to three of them. One of such answers found that the Plaintiff had assumed the risk of injury. Another answer found the Plaintiff free of contributory negligence. The Court then entered judgment in favor of the Defendants. The Plaintiff moved for a new trial. One of the Defendants has moved for a directed verdict in the event Plaintiff’s motion is granted.
