Defendant, G. M. Cobum, was charged in the county court of Payne county with the crime of unlawful possession of intoxicating liquor, to wit, 15 pints of whisky; was tried, convicted, and sentenced to pay a fine of $100 and to serve 60 days in the county jail. From this judgment and sentence he has appealed.

A motion to dismiss this appeal has been filed by the state. A response thereto has been filed by defendant. From an examination of the record the motion to dismiss the appeal is overmled and this case, which has been briefed both by the defendant and the state, will be considered on its…
