Error to the Court of Common Pleas of Berks county: Of January Term 1877, No. 130. This was an amicable action by Philip Shingle, against the directors of the poor of Berks county, wherein a case was stated which will be found, in effect, in the opinion of this court.

Philip Shingle, the plaintiff below, was constable of Union township in the year 1874. On the 7th of April in that year, an order was issued ‘to him by two justices of the peace to convey Jacob Carver, of Amity township, a pauper, to the Berks County Poor House. In executing the order he charged mileage at the rate of fifteen cents per mile circular for the distance he was required to travel. The defendants below apparently admitted their liability for mileage at the rate of ten cents, for the case stipulated for a judgment of $5.40 if the claim for the larger rate was sustained, and for a…
