The .plaintiff in error, hereinafter referred to as the defendant, pleaded guilty to manslaughter in the first degree, and was sentenced to serve a term of five years in the state penitentiary at McAlester. From which judgment the defendant appeals.

The defendant demurred to the information, on the ground:

“That the same wholly failed to state facts sufficient to. constitute a crime or public offense within the jurisdiction of this court; that same is so vague, indefinite and uncertain that the defendant cannot properly prepare and interpose his defense thereto.” Which demurrer was overruled,…
