The complainant seeks to have a legacy of $1000, given to her by the will of her late husband Gilbert L. Dey, declared a charge on the real estate of the testator, and paid out of the proceeds of the sale of it. The defendant John-B. Wykoff, had been appointed administrator, with the will of the testator annexed, by the Orphans Court of the county of Middlesex, which had removed the executors named in the will.
