Appeal by defendant from a judgment of the Supreme Court, Richmond County, rendered June 4, 1975, convicting him of criminal sale of a controlled substance in the first and second degrees, and criminal possession of a controlled substance in the first and third degrees, upon a jury verdict, and imposing sentence. Judgment reversed, on the law, the fourth count of the indictment, charging criminal possession of a controlled substance in the first degree, is dismissed and a new trial is ordered as to the remaining counts of the indictment.
