Appeal from circuit court, New York county. Action by Pierce S. Marx against the Manhattan Railway Company. There was a judgment for plaintiff, and defendant appeals. For former report, see 3 H. Y. Supp. 113.

This action was brought to recover damages for injuries claimed to have been sustained by the plaintiff to his eye, while standing beneath the defendant’s railway in the Bowery, from coal falling from one of the defendant’s engines. The trial resulted in a verdict for the plaintiff, and from the judgment thereupon entered, and an order denying a motion for a new trial, this appeal is taken. Various exceptions are brought up upon this record, but in the disposition of this appeal it will be only necessary to consider those taken to the exclusion of the evidence of Dr. Knapp, a witness called…
