Plaintiff is a national and citizen of Nigeria who is subject to a final order of removal and in the custody of Immigration and Customs Enforcement (ICE) pending his removal. He is also awaiting a final decision-which could still be years away-from U.S. Citizenship and Immigration Services (USCIS) on his application for U nonimmigrant status, also called a U-visa.
