A jury convicted Freeman Brooks of the murder of Castoria Jones, Jr., and fixed his punishment at 14 years in the penitentiary. A writ of error issued by the Supreme Court to review his conviction was transferred to this court.

The defendant, Freeman Brooks, 66 years of age, was a widower who lived alone in a third floor apartment at 4725 Indiana Avenue, Chicago. Lucille Chapman, her eight-year-old daughter, and the man Mrs. Chapman was living with, Castoria Jones, Jr., 29 years of age, occupied an adjacent apartment.
