While I agree with the results reached by the majority, I disagree with the logical roadmap employed: following it could lead to an erroneous destination in another case.

Kelly appeals from his convictions and sentences for attempted second degree murder (§§ 777.04(1); 782.04(l)(a), Fla. Stat.), armed burglary (§ 810.02(2)(b), Fla. Stat.), and use of a firearm in the commission of a felony (§ 790.07(2), Fla.Stat.). He was also found guilty of violating his probation in connection with an aggravated battery conviction in 1978.
