JUNELL, Justice.

This case and its companion, Rotello, et a 1. v. Brazos County Water Control & Improvement District No. 1, were consolidated by the Texas Supreme Court when it passed on the question of whether the litigants are properly before this court by writ of error.1 This court previously dismissed the writs of error.2 This cause is before us on remand for a determination of the merits of appellants’ claims asserted in the writ of error.
