. Hatch, J.:

The averments of the complaint present this case in two aspects. The first allegation is that the plaintiff, at the special instance and request of the defendant, consigned to the defendant certain merchandise for sale for the account of the plaintiff, setting forth the character of the merchandise and its value. The complaint then avers that the defendant sold the goods and received the proceeds of sale, but has not paid over the same except in an amount speci"fied.
