The plaintiffs in this action challenge the policy pursuant to which the New York City Transit Authority (the “TA”) tests its employees and applicants for employment to determine if they have recently used marijuana. During the course of discovery, a dispute has arisen concerning the plaintiffs’ access to information contained in the files of TA employees and applicants.
