—The action was commenced in November, 1873, on behalf of the plaintiff and other creditors of the insolvent firm of Townsend, Baker & Co., for an accounting by the defendant, as their assignee under an assignment executed December 28, 1867. When the cause was reached for trial, February 12, 1874, an accounting was ordered, and it was referred to the Hon. Enoch L. Faneher to take and state the accounts of the assignee, to ascertain and report who were the creditors of Townsend, Baker & Co., and the amounts respectively due them; also, what fees, commissions and disbursements…
