AKIN, Justice.

This is an appeal from an order overruling a plea of privilege. Plaintiffs filed suit in Dallas County alleging violations of the Texas Deceptive Trade Practices Act. Defendant, a resident of Ellis County, filed a plea of privilege and plaintiffs controverted it, relying on the venue exception contained in the act. Tex.Bus. & Com.Code Ann. § 17.56 (Vernon Supp.1978-1979). 1 The tri al court overruled defendant’s plea of privilege.
