RICHARD LEON, District Judge.

Plaintiffs are a group of 35 current and former, Federal Bureau of Investigation (“FBI” or “Agency”) agents that brought an action against Eric Holder, the Attorney General of the United States (“defendant”) in his official capacity as the Cabinet secretary who oversees the FBI. Plaintiffs claim the FBI violated the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 683a, through a policy that imposes a term limit to field positions held by grade GS-14, Supervisory Special Agents (“SSAs”).
