The state has appealed from a judgment sustaining a motion in arrest of judgment.

The defendant was convicted of having committed a misdemeanor by moving a mortgaged automobile from the parish where the mortgage was given and recorded, without the written consent of the mortgagee. The indictment was founded upon sections 5 and 8 of Act 198 of 1918, p. 372, which seem to make it a misdemeanor for a mortgagor to move the mortgaged property from the parish where the mortgage was given without the written consent of the mortgagee, designating the parish or parishes to which the property may be…
