MEMORANDUM

WARRINER, District Judge.

In this action plaintiff, Ezra H. Barnes, Jr., seeks compensatory and punitive damages from defendant Litton Industrial Products, Inc. for injuries sustained from plaintiff’s consumption of a product called “burning alcohol” distributed and sold by defendant through its subsidiary Litton Dental Products. Unaware of its toxic nature, plaintiff consumed a substantial amount of this product and thereby injured his optical system rendering him blind. The gravamen of this action is that his blindness was a proximate result of defendant’s breach of its duty…
