On March 31, 1920, appellant and appellee’s assignor entered into a written contract for the sale of certain real estate in the town of Rock Valley, Iowa. The consideration recited in said contract for the purchase of said premises was $8,000. The sum of $1,000 was paid in cash upon the execution of the contract, and the balance was to be paid in three installments. None of said deferred payments having been made, this action for specific performance was instituted, October 6, 1921.
