This is a case stated. The sheriff of Westmoreland County, as plaintiff, agreed with the commissioners, controller, and treasurer of the county, as defendants, to state a case raising the question of the liability of the county for the premiums payable to the Continental Casualty Company as surety on the official bond and recognizance of plaintiff.
