On August 15, 2008, 2008 WL 3843569, the Magistrate Judge issued a Report and Recommendation recommending that the instant petition for a writ of habeas corpus be dismissed. Petitioner has filed objections to the Magistrate Judge’s Report and Recommendation. Petitioner objects solely to the Magistrate Judge’s recommendation of dismissal of claim two, in which he asserts that his sentence violates Blakely v.
