A history of this case and a review of the essential facts prior to the present controversy appear in the opinion in the first appeal, 148 Pa. Superior Ct. 142, 24 A. 2d 743. Following our award of a procedendo, further hearing was held in the court below on April 15, 1942, but no additional testimony was taken.
