This is an appeal from a decree, rendered by Mr. Justice Crounse, sitting in the District Court for Douglas county. The bill was filed on the 21st day of August, 1865, in the District Court of the late Territory of Nebraska. It seeks to set aside as fraudulent and void as to creditors, a mortgage upon the premises in question, made by George Bridge ' to Charles Bridge, on the 17th day of October, 1857, or to redeem the said mortgage, if upon the hearing, it should appear to have been made dona fide. Their purpose may be to place the record of this cause in the. United States Circuit Court and proceed to trial therein, notwithstanding the, order of this court in the premises.
