The charge against the defendant is what is commonly called statutory rape, alleged to have been committed by the defendant on or about the 16th day of February, 1926, upon the prosecutrix, who was under 16 years of age. Upon trial, the jury returned a verdict against the defendant, finding him guilty of the crime of rape, and the judgment of the court was that the defendant be confined in the state reformatory at Anamosa for an indeterminate term of not more than ten years.
