MEMORANDUM ON PLAINTIFFS’ MOTION TO REMAND AND DEFENDANTS’ MOTION TO DISMISS
STEARNS, District Judge.
Plaintiffs Jonathan 0. Straus, a beneficiary of the Oliver H. Straus Trust (the “Trust”), his wife Francine Straus, and their minor son, James J. Straus, originally filed this lawsuit in the Massachusetts Superior Court. The complaint alleges mismanagement of the trust corpus and breach of fiduciary duty on the part of the defendant trustees.
