PRICE, Chief Justice.

This action was instituted by Polk Spring, as plaintiff, against the Meco Production Company, defendant. Plaintiff, in •the form of trespass to try title, specially pleading his title, sought to establish a preference right against defendant to acquire a preference right to lease for production of oil and gas a tract of 18.71 acres situated in Rusk County, Texas. Trial was before the court and resulted in a judgment in favor of defendant. Plaintiff duly perfected his appeal and the case is here for review.
