I. Background

Wallace Kim Mired brought this action against his former employer and its sueces sor in interest, asserting five claims under the Americans with Disabilities Act (ADA), a claim under the Utah Anti-Discriminatory Act, and a claim for intentional infliction of emotional distress. He had been diagnosed with acquired immune deficiency syndrome (AIDS) and died on June 1, 1996, from its complications.
