This action is brought against the defendants as guarantors for “ the faithful performance ” of .a written contract, made by Charles S. Holmes with the plaintiff, dated November 5, 1872. This contract was actually made November 25, but was dated back to November 5 for reasons which will hereafter appear. The material portions of the contract are, that Holmes, in consideration of one dollar paid by the plaintiff and other good and sufficient considerations, agrees “to assume and pay all the debts, notes and accounts due from the late firm of Thayer and Brother, or which may have been incurred…
