We have presented to us for determination a matter of statutory construction which reaches us as the result of a decision of the United States Court of Appeals for the Second Circuit in the case of Paris v. Metropolitan Life Ins. Co. (167 F. 2d 834, certiorari denied 335 U. S. 827). That *383decision reversed a declaratory judgment of the District Court (68 F.
