On the 6th of June, 1918 plaintiff’s intestate was run over by an auto truck and sustained injuries which resulted in his death. Thereafter this action was brought on the ground that his death was due to the negligence of the defendants. There have been two trials. At the first, at the close of the evidence, the complaint was dismissed as to the Motor Truck Renting Corporation and Hagerty Motor Trucking Company, and submitted to the jury as to Rodgers & Hagerty.
