Insurance Concepts, Inc. (“Insurance Concepts”), an insurance agency, brought this diversity action alleging that Western Life Insurance Company (“Western Life”) had breached a written settlement agreement by which the parties terminated previous litigation in the district court. This dispute arose when Western Life refused to fulfill its obligation under the settlement agreement to pay its former general agent, Insurance Concepts, approximately $22,000 in “renewal commissions” that the agent had earned from the sale of Western Life’s insurance policies.
