This action was brought upon a promissory note dated January 6, 1899, made by the defendant, payable three months after the date thereof, to the order of W. E. Williams, at the Central Bank, Rochester, N. Y., for thirty-nine dollars and interest. Before maturity the note was indorsed by Williams, the payee, and transferred to the plaintiff. t_ The day the note became due (April 6, 1899), shortly after ten o’clock, á messenger from the plaintiff presented the note at the Central Bank and requested payment, which was refused because the defendant’s account was not good.
