We withdraw our opinions issued January 9, 2007, issue the following opinion in their place, and overrule appellees’ motion for rehearing.
This is a consolidated interlocutory appeal and petition for writ of mandamus challenging the trial court’s May 13, 2005 order denying a motion to compel arbitration filed by appellant, homebuilder TMI, Inc., d/b/a Trendmaker Homes (“Trend-maker”).
