Tbe judge found tbe following facts :

1. That tbe plaintiff above named and tbe defendant were duly married on 10 February, 1901.

2. That on 1 April, 1913, tbe defendant separated himself from tbe plaintiff and lived separate and apart from ber until tbe time of tbe commencement of this action, during which time bis whereabouts were unknown to tbe plaintiff.

3. That thi¡3 action was commenced on 4 April, 1918, by summons duly issued, returnable at tbe May term of tbe Superior Court of Guil-ford County; that tbe sheriff of Guilford County returned said summons with tbe following endorsement: “Tbe…
