The plaintiff in error, hereinafter called defendant, was convicted in the county court of Pittsburg county on a charge of pointing a gun and was sentenced to serve a term of 3 months in the cbunty jail and to pay a fine of $50.

The prosecution is based on section 1999, Comp. St. 1921. The charging part of the information is as follows:

“* * * That Oscar Lawrence, in the county and state aforesaid, on the day and year aforesaid, did willfully, wrongfully, and unlawfully point a deadly weapon, to wit, 38 Winchester, No. 304597, 38 W. C. F., to and at one Wallace Creasy and other persons, in the…
