Defendant Mack T. Cole was charged with the murder of his wife but pleaded guilty to the lesser included offense of voluntary manslaughter pursuant to plea negotiations. Hie defendant was originally sentenced to a term of 12 to 20 years. On one previous appeal that sentence was vacated and his case remanded to the circuit court for a new sentencing hearing. On November 16, 1973, the trial court imposed a sentence of not less than 6 years and 8 months nor more than 20 years.
