This is a suit in damages for personal injuries alleged to have been sustained by plaintiff through slipping, or stepping, into a hole in the sidewalk on the east side of Main street, in front of No. 1125, in Kansas City, Mo., at about 4:30 P. M. on January 6, 1916.

This is the second appeal in the case. On the former trial the judgment was in plaintiff’s favor in the sum of $4000. There were included as parties defendant in that suit a number of persons who were owners of adjacent property. Demurrers were sustained as to these and they are no longer parties to the controversy.
