This action was brought to recover damages to a farm from flooding, claimed to have been caused by acts of the defendant. The cause was tried to the court and a jury and resulted in a verdict in favor of the plaintiff for the sum of $2,500. Motion for judgment notwithstanding the verdict and, in the alternative, for a new trial being made and overruled, judgment was entered upon the verdict, from which the defendant appeals.

The respondents are the owners of a farm or ranch in Snohomish county, consisting of approximately fifty-six acres. The southern boundary of this farm is the Stillaguamish…
