An order for the partition of the lands described in the complaint, between the plaintiffs and the defendants, was made by the Clerk of the Superior Court of Northampton County on the 24th of August, 1898, and on the 29th of November following, the report of the commissioners, who had been appointed to divide the lands, was filed in the Clerk’s office. The plaintiffs, except E. J. Floyd, through their counsel, on the 2d of January, 1899, issued a notice to the defendants that they would move before the Clerk on the 18th instant, to set aside he judgment for partition in the cause.
