On a Sunday evening, October 6, 1935, Dallas Nelson, plaintiff’s intestate, lost his life as the result of injuries sustained while he was engaged in attempting to alight from defendant’s train at its station at Lynchburg, after he had boarded the train for the purpose of assisting his friend Elise McElveen to board the train as a passenger to Baltimore.
