This action is brought to recover $1,000 paid on the purchase price of certain real property in the city of Buffalo, and for certain other items set forth in the complaint.

The defendant Hattie L. Guernsey appears to have been the owner of an undivided half of the property sold. Geraldine B. Smith, Alice E. Gates, Marjorie H. Smith and Ruth L. Smith were the owners of the other undivided half. So far as I can discover, the defendant William J. J.
