Error to a judgment of the Circuit Court of Albemarle county, rendered October 16, 1900, in an action of trover, wherein the defendant in error was the plaintiff, and the plaintiff in error and others were the defendants.

Asa Snyder & Company instituted an action on the ease in the Circuit Court 'of Albemárle county against Langley & Company and the Rector and Visitors of the University of Virginia, and filed their declaration containing three counts. The defendants demurred to the declaration as a whole, and to each count thereof. The court sustained the demurrer to the first and second counts, and overruled it with respect to the third count, which is in trover, the plaintiffs averring that on the 15th of May, 1897, they were lawfully possessed of certain…
