Defendant James Edward Delts was indicted by the Somerset County grand jury and charged in the first of two indictments (No. 340-80J) with attempting to acquire or obtain Talwin, a controlled dangerous substance, by misrepresentation and fraud, in violation of N.J.S.A. 24:21-24 and N.J.S.A. 24:21-22 a(3), and in the second (No. 477-80M) with attempting to acquire or obtain Ritalin, a controlled dangerous substance, by misrepresentation and fraud in violation of N.J.S.A. 24:21-24 and N.J.
