In this case, Stanley Howard (“Howard”), a patient receiving psychiatric care at the New England Deaconess Hospital (“hospital”), escaped from the hospital and jumped from a building to commit suicide. While jumping from the building, Howard injured the plaintiff, John Carr (“Carr”). Carr brought this negligence action against Howard’s treating psychiatrist, Kerry Bloomingdale, M.D. (“Dr. Bloomingdale”).2 The defendant, Dr. Bloomingdale, moves for summary judgment pursuant to Mass.R.Civ.P. 56 on all counts of the complaint on the ground that she owed no duly of care to protect the plaintiff…
