The motion of the claimant for an order pursuant to CPLR 3212 granting him summary judgment against the defendant upon the liability issue is granted.
This claim arises from a motor vehicle accident which occurred on February 16, 1996 at approximately 7:00 a.m. at the intersection of Farm to Market Road and Pruyn Hill Road in the Town of Halfmoon, New York.
