This matter is before us on appeal from a decision of the Court of Common Pleas of Dauphin County. The court affirmed an order of the Pennsylvania Liquor Control Board (Board) assessing a fine against licensee Arthur A. Banks (appellant).

The Board cited appellant for operating the licensed premises, known as Otto’s Atmosphere II (Otto’s), in a noisy and disorderly manner on March 28, 1980, and “on divers other occasions within the past year,” in violation of Section 471 of the Liquor Code.1 Following a hearing, the Board found that a violation of the aforesaid…
