Order of the City Court of Mount Vernon dated January 26, 1934, reversed on the law and the facts, with ten dollars costs and disbursements, and the motion *839granted, with ten dollars costs. No general appearance by the defendant had been effected in this action; no summons had been served and, therefore, the court had no jurisdiction over the person of the defendant.
