This is an appeal from an order overruling appellant’s plea of privilege and pertains to Vernon’s Tex.Rev.Civ.Stat.Ann. Art. 1995, subdivision 23.

Appellee, Austin Paving Company, sued, appellant, Bartex, Inc., in the district court of Travis County for the alleged breach of a written contract by the terms of which appellee was to perform “site grading” for a housing project in Austin.
