This action is in partition and was instituted to determine title to premises formerly lying between high- and low-water mark at Rockaway beach, but now filled in by the city of New York, and to adjudge that neither the city of New York nor the State has any interest in these premises, but that plaintiff and Clinton Street Realty Corporation are seized in fee. The premises are described as bounded on the north by the high-water line of the Atlantic ocean as it existed in 1925, and on the south by the north line of the public beach or boardwalk.
